Expropriation law
Property deprivation
We provide specialized knowledge of expropriation law, namely in connection with large infrastructure projects. Expropriation (formal and material expropriation) is the legal term for the deprivation of property by the state or the restriction of powers deriving from property in return for compensation.
Expropriation for transport, military and other reasons inherent in the governmental tasks must be based on an senior purpose serving the common good. Since property is one of the fundamental rights in market-based democracies, expropriation is possible here only in certain exceptional cases ruled by law.
